Could Christa Pike walk free if she wakes up after the botched execution? Under US law, the answer is no.<\/strong><\/p>\n

Could Christa Pike be set free if she survives? That\u2019s what people keep asking on X, days after Tennessee failed to execute her twice in one night.<\/p>\n

<\/div>\n

\u201cWhat would happen if Christa Pike doesn\u2019t die from her two lethal injections? Could she be set free?\u201d one user wrote.<\/p>\n

Pike is unconscious and on a ventilator, and her lawyers say hospital staff are working to clear the drug from her system after the botched execution attempt.<\/p>\n

Defense lawyer Randy Spivey said the team worked for an hour and he counted at least seven needles in her left arm.<\/p>\n

According to her lawyers, Pike was still snoring when the microphone in the execution chamber was switched off, more than an hour in.<\/p>\n

Surviving would not wipe the sentence<\/strong><\/h2>\n

A botched execution doesn\u2019t cancel a conviction, and it doesn\u2019t release anyone from custody. Pike was convicted of killing 19-year-old classmate Colleen Slemmer in 1995, when she was 18.<\/p>\n

Even if her lawyers manage to stop the state from trying to execute her again, she wouldn\u2019t go free. The sentence would most likely become life in prison without parole.<\/p>\n

A failed attempt doesn\u2019t automatically block a second one. The key Supreme Court case goes back to 1947, Francis v. Resweber, where the court ruled that a second attempt after an electric chair malfunction didn\u2019t break the Eighth Amendment ban on cruel and unusual punishment.<\/p>\n

More recent cases where inmates survived because of IV problems or protocol failures point the same way. These prisoners stayed in prison, some of them were executed later, after the state changed its procedures.<\/p>\n

Others got years of legal delays or had their sentences reduced to life.<\/p>\n

What her lawyers can still do<\/strong><\/h2>\n

Pike\u2019s team can now file federal and state motions saying a second attempt, after the injuries to both her arms, would be cruel and unusual punishment. They can also ask Tennessee officials for clemency again, which would let the governor reduce her sentence to life without parole.<\/p>\n

Governor Bill Lee has ordered a review of the state\u2019s execution procedures and put Pike\u2019s execution on hold indefinitely, along with one other planned for this year.<\/p>\n<\/div>\n
